This privacy policy (“Privacy Policy”) describes Gorjana and Griffin’s (“Gorjana” or the “Company”) policies and practices regarding the collection, use, and disclosure of personal information we collect about consumers, including personal information we obtain when you access or use this website and our mobile app (collectively, “Site”), or through other channels including but not limited to visiting one of our locations, phone and email conversations, attending our events, social media interactions on our websites and social media platforms, or through our authorized services providers. The creation of this Privacy Policy grows from our fundamental respect for your right to privacy and will serve to guide our relationship with you. We value the privacy and security of your personal information (“PI”) which as used herein means information that identifies or is reasonably capable of identifying you. As such, we take complying with data privacy and security laws very seriously.
If you provided us with your personal information, or we obtain personal information about you from other sources, we treat your personal information according to this Privacy Policy. This Policy is incorporated into and subject to the Terms of Use.

BY ACCESSING OR USING THE SITE OR PROVIDING US WITH YOUR PERSONAL INFORMATION THROUGH OTHER CHANNELS, YOU CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF YOUR INFORMATION AS SET FORTH IN THIS PRIVACY POLICY.
From time to time, we will update this Privacy Policy as we adopt new practices and procedures related to your personal information. If we make material changes to this Privacy Policy, we will revise the “Last Updated and Effective Date” above and, in some cases, we may send you a notice of our changes as well if you have provided us your e-mail or mailing address. We collect PI about you when you purchase products, register for an account, contact Customer Service, apply for a position with us, submit a wholesale application, or through web technology tools when you visit our website.
The following chart sets forth the categories and types of PI we may collect or have collected about you, how we use that information, and for each type of personal information collected, the categories of third parties to whom we may or have disclosed, Sold, or Shared that personal information in the preceding 12 months.
In general, we use the PI we collect only for the purpose it was collected, for compatible purposes, as permitted or required by law, as necessary to carry out our contractual duties and obligations, and as otherwise provided in this Privacy Policy. If we need to use your PI for an unrelated purpose, we will notify you. Please note that we may process your PI without your knowledge or consent where this is required or permitted by law.
In general, we will not disclose your PI except with your consent and as described in this Policy. We may disclose your PI for the purposes that we may use it, as described in this Policy, to the following categories of parties:
Services providers or contractors who help us with shipping, payment processing, marketing and advertising, email, text and other communications, applications, sales, business and inventory support, photography, and website administration and hosting, data storage and other technical services. Some of these service providers may collect your information on our behalf.
Our affiliated entities or business partners. For example, as part of promotions or events. These business partners should have their own privacy policy and we encourage you to review them.
Manufacturers, agents and distributors who provide agency and distribution services to us.
Vendors that assist us with creating marketing profiles, delivering targeted ads, conducting debt collection, providing merchandizing platforms, etc.
Professional advisors including lawyers, accountants, auditors, bankers, insurers, who provide consultancy, banking, legal, insurance and accounting services.
Social networks in connection with marketing.
Third parties for legal or regulatory related purposes. We may disclose your PI to third parties as necessary to: (1) comply with federal, state, or local laws; (2) comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; (3) cooperate with law enforcement agencies concerning conduct or activity that we reasonably and in good faith believe may violate federal, state, or local laws; or (4) exercise or defend legal claims.
Third parties related to a transfer of assets. We may also disclose your PI to evaluate or perform a transfer to a third party as part of a merger, acquisition, bankruptcy, or other transaction in which the third party assumes control of all or part of our business.
We may Sell or Share your PI for the same reasons we collect and use it, as set out in this Policy. Please note that Sell and Share may have different meanings depending on the applicable state law.
You do not have to provide your personal information; however, if you do not provide specific information when requested, you may not be able to access all functions or areas of the Site, and we may be unable to provide you with certain information or Site features, process your purchase order, or process your application for employment.
If we add to the categories of PI we collect, the purposes for which we use it, or the third parties to whom we disclose, Sell or Share it, we will inform you by posting an updated version of this Policy on the Site.

Nosto. This merchandising/personalization platform tool collects customer data on our behalf through tracking and session cookies (i.e., to identify browsers between their visits to the site) for purposes related to generating statistics, preferences, personalizing marketing, and tailoring online advertising to your interests.
Facebook meta pixel. This pixel is used for tracking and serving targeted ads. It tracks information such as your page view, view content, search, add to cart, purchase information, sign up, download, submit form, or user information (IP address, browser information). This data is anonymized.
Email pixel tracking. We may embed email pixels in emails we send you. When you open the email, is sends back information. These pixels help us determine information including how many people open our emails, click on links, the percentage of recipients who read email on their phones, etc. We use this information for marketing purposes and to learn more about our audience.
Google Analytics. The Site may use Google tools to help us analyze utilization of the website, track users, help with audience measurement, or with customer match. These tools may collect user information (e.g., IP address, browser, device type, OS, location), website traffic information, content information (e.g., page views), goal completion (e.g., completion of certain actions on the website such as making a purchase), and e-commerce information (e.g., average order value, product views). - SOCIAL MEDIA SHARING FEATURES
This Site may offer social media sharing features or other integrated tools, which let you share actions you take on this Site with other media, and vice versa. - HOW LONG WE RETAIN YOUR PERSONAL INFORMATION
We retain your PI for as long as necessary to satisfy the purpose for which it was collected. We may retain your PI for longer if it is necessary to comply with our legal or reporting obligations, resolve disputes, collect debts, etc. or as permitted or required by applicable law. We may also retain your PI in a deidentified or aggregated form so that it can no longer be associated with you.
To determine the appropriate retention period for your PI, we consider various factors such as the amount, nature, and sensitivity of your information; the potential risk of unauthorized access, use or disclosure; the purposes for which we process your personal information; and applicable legal requirements.
- APPLICABLE LAW
This Policy is governed by the internal substantive laws of California, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within California. If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy, which shall remain in full force and effect.

You can always limit the information you provide to us, but if you choose not to provide certain requested information, you may be unable to access some of the services and content on the Site. Additionally, you will need to describe your request with sufficient detail to allow us to review, understand, assess, and respond. We will not use the PI we collect from an individual to determine a verifiable request for any other purpose, except as required by law.
Fees. We reserve the right to charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded. If we determine that a request warrants a fee, we will attempt to notify you as to why we made that decision and provide a cost estimate before completing your request.
Response. We will attempt to respond to a verifiable Consumer request within forty-five (45) days of receipt, but we may require up to ninety (90) days to respond, under which circumstances we will notify you of the need for an extension. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the receipt of your verifiable Consumer request.
- California residents: With respect to Personal Information collected on and after January 1, 2022, and to the extent expressly permitted by applicable regulation, you may request that such disclosures cover a period beyond the 12 months referenced above, provided doing so would not be impossible or require a disproportionate effort by us.
Appeals: Colorado, Connecticut, Montana, Oregon and Virginia permit you to appeal our decision if we deny your rights request. To do so, send us an email at privacy@gorjana.com appealing the decision within 30 days from the date of our denial. Please include the following information:

- Date of our denial
- Basis for appealing our denial

Agents. Subject to certain limitations, you may authorize a natural person or a business registered with the applicable Secretary of State to act on your behalf with respect to exercising your rights under a state section. Unless you have provided the authorized agent with a qualifying power of attorney, you must provide your authorized agent with written permission (signed by you) to act on your behalf and verify their identity with us. We reserve the right to deny requests from persons or businesses claiming to be authorized agents that do not submit sufficient proof of their authorization. The following state- specific limitations apply to agents:
- Colorado, Texas: An agent may submit only a request to Opt Out of the processing of Personal Data concerning the Consumer for purposes of Targeted Advertising or the Sale of Personal Data.
- Connecticut, Delaware, Montana, Nebraska, New Hampshire, New Jersey and Oregon: An agent may exercise only the right to Opt Out of processing of Personal Data concerning the Consumer for purposes of Targeted Advertising, the Sale of Personal Data, or Profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning the consumer.
This Site recognizes and processes opt-out preference signals sent from your browser that indicate your intent to opt out of the Sale or Sharing of your Personal Information (CA) or the processing of your Personal Data for a Sale or Targeted Advertising. We will not charge you a fee or require any valuable consideration if you use the opt out signal nor will we change your experience with our website or the products and services we offer.
